1. Acceptance of Terms

By accessing and using the services of CaptrFit Private Gym Noordwijk ("we," "our," or "us"), you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Membership Services

2.1 Membership Tiers

We offer the following membership tiers:

  • Core: €90/month - 2 sessions per week, 6am-10pm access
  • Premium: €129/month - 3 sessions per week, 24/7 access
  • Elite: €219/month - Unlimited sessions, 24/7 access, priority booking
  • Elite+: €499/month - All Elite benefits plus personal training and nutrition consultation

2.2 Membership Terms

  • All memberships are recurring monthly subscriptions
  • Billing occurs on the same date each month
  • Members must book sessions in advance through our booking system
  • Unused sessions do not carry over to the next month
  • Membership upgrades take effect immediately; downgrades at the next billing cycle

2.3 Minimum Commitment Period

3-Month Minimum Commitment (Effective January 8, 2026)

All recurring membership subscriptions (Core, Premium, Elite, Elite+, and Off-Peak) require a minimum commitment period of three (3) months from the date of your first payment.

  • What this means: You agree to maintain your subscription and make payments for at least three consecutive months.
  • Early cancellation: You may request cancellation at any time through your account dashboard. If you cancel before completing your 3-month commitment, your cancellation will take effect at the end of your third billing cycle, and you will be charged for the full commitment period.
  • After commitment: Once your 3-month commitment is fulfilled, you may cancel your subscription at any time with 30 days notice as described in Section 7.1.
  • Example: If you subscribe on January 1st, your commitment period ends on April 1st. If you request cancellation on February 15th, your subscription will remain active until April 1st, and you will be charged for January, February, and March.
  • Existing members: Members who subscribed before January 8, 2026 are exempt from this minimum commitment requirement and may cancel under the standard 30-day notice policy.
  • Your rights: This commitment policy does not affect your statutory rights under Dutch and EU consumer protection law.

3. Booking and Cancellation Policy

3.1 Booking Rules

  • Sessions must be booked in advance through our online booking system
  • Booking windows vary by membership tier (14-30 days in advance)
  • Members are limited to their tier's session allowance
  • No-shows count as used sessions

3.2 Cancellation Policy

  • Sessions can be cancelled up to 24 hours before the scheduled time
  • Late cancellations (less than 24 hours) will result in session forfeiture
  • Emergency cancellations may be considered on a case-by-case basis

4. Facility Rules and Code of Conduct

4.1 General Rules

  • Proper athletic attire must be worn at all times
  • Equipment must be cleaned after each use
  • Weights and equipment must be returned to designated areas
  • No photography or recording without explicit permission
  • Respect other members' privacy and personal space

4.2 Prohibited Activities

  • Harassment, intimidation, or discrimination of any kind
  • Use of illegal substances or performance-enhancing drugs
  • Damage to equipment or facilities
  • Commercial activities without prior authorization
  • Sharing access codes or membership credentials

5. Health and Safety

5.1 Health Declaration

By using our facilities, you confirm that you are in good physical condition and have no medical conditions that would prevent safe participation in physical exercise. We recommend consulting with a healthcare provider before beginning any fitness program.

5.2 Assumption of Risk

You acknowledge that physical exercise involves inherent risks. You voluntarily assume all risks associated with your use of our facilities and services.

6. Payment Terms

6.1 Billing

  • All payments are processed through our secure payment provider (Mollie)
  • Membership fees are charged monthly in advance
  • Failed payments may result in temporary suspension of access
  • All fees are in Euros (€) and include applicable taxes

6.2 Refund Policy

  • Membership fees are non-refundable except as required by law
  • No refunds for unused sessions or early termination
  • No refunds will be issued for cancellations made during the 3-month minimum commitment period
  • Pro-rated refunds may be issued for extended facility closures beyond our control
  • If you believe you have grounds for a refund due to exceptional circumstances, please contact our support team

7. Membership Cancellation

7.1 Standard Cancellation Process

For members who have completed their 3-month minimum commitment period:

  • You may cancel your subscription at any time through your account dashboard
  • Cancellations require 30 days notice and take effect at the end of your current billing period
  • You will retain full access to our facilities until the end of your paid period
  • No cancellation fees apply after the commitment period is fulfilled

7.2 Cancellation During Commitment Period

If you request cancellation before completing your 3-month minimum commitment:

  • You may submit a cancellation request at any time through your account dashboard
  • Your cancellation will be scheduled to take effect at the end of your 3-month commitment period
  • You will continue to be charged monthly until your commitment period ends
  • You will retain full access to all facilities and services during this time
  • You may reactivate your subscription at any time before the scheduled cancellation date
  • Your dashboard will clearly show your scheduled cancellation date

7.3 Exceptional Circumstances

We understand that life circumstances may change unexpectedly. In cases of genuine hardship (such as serious illness, injury, or relocation), please contact our support team. While we cannot guarantee early release from the commitment period, we will review each case individually and work with you to find a fair resolution.

7.4 Membership Freeze

  • Members may request a freeze for medical reasons or extended travel
  • Freeze requests require supporting documentation
  • Maximum freeze period is 3 months per year
  • The commitment period is extended by the duration of the freeze
  • Billing resumes automatically after the freeze period

7.5 Subscription Changes During Commitment

If you upgrade or downgrade your membership tier during your commitment period:

  • Upgrades: Any remaining months in your original commitment will transfer to the new tier
  • Downgrades: Will take effect at the end of your commitment period for your current tier
  • Example: If you have 2 months remaining on Core and upgrade to Premium, you will have a 2-month commitment on Premium

7.6 Failed Payments During Commitment

If a payment fails during your commitment period:

  • Your access will be temporarily suspended until payment is resolved
  • Your commitment period continues regardless of payment status
  • You will need to update your payment method and settle any outstanding charges to restore access
  • After three consecutive failed payment attempts, your subscription may be cancelled, but you remain liable for payments due during the commitment period

8. Intellectual Property

All content on our website and in our facilities, including logos, text, images, and training programs, is our property or licensed to us. You may not use, reproduce, or distribute any content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, including but not limited to personal injury, lost profits, or property damage.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your violation of these terms or your use of our services.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes indicates acceptance of the modified terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
